2. Description of Service
Bernar is a multi-platform content scheduling and auto-posting service with MCP integration for AI agents. Bernar helps users connect social accounts, prepare content, schedule publications and publish content across supported third-party platforms.
Bernar publishes content through third-party platform APIs, including the TikTok API, Meta API for Instagram, and YouTube Data API. Platform features may depend on each provider's API availability, approval status, rate limits and policies.
3. User Accounts and Responsibilities
You are responsible for maintaining the confidentiality of your account credentials, connected social accounts, OAuth authorizations and any activity that occurs under your account. You must provide accurate information and use Bernar only in compliance with applicable laws and platform rules.
4. Content and Third-Party Platforms
You retain responsibility for all videos, captions, metadata, schedules and other materials that you upload, create, approve or publish using Bernar. You are solely responsible for ensuring that your content complies with the rules, community guidelines and developer policies of TikTok, Instagram, YouTube and any other connected platform.
Third-party platforms may reject, remove, limit, delay or otherwise moderate content. Bernar is not responsible for platform decisions, policy enforcement, account restrictions or API outages.
5. Prohibited Uses
You must not use Bernar to:
- publish unlawful, harmful, deceptive, infringing, abusive or otherwise prohibited content;
- violate TikTok, Meta, Google, YouTube or other third-party platform policies;
- misuse OAuth tokens, credentials, accounts or API access;
- attempt to bypass rate limits, security controls, moderation systems or access restrictions;
- interfere with the integrity, security or availability of Bernar or third-party services.
6. Intellectual Property
Bernar and its software, design, branding, documentation and related materials are owned by Bernar or its licensors. These Terms do not grant you any ownership rights in Bernar. You retain ownership of your content, subject to the permissions needed for Bernar to operate the Service.
7. Disclaimer of Warranties
Bernar is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Bernar disclaims all warranties, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement and uninterrupted availability.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Bernar will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, data, content, reputation, platform access or business opportunities arising from your use of the Service.
9. Termination
We may suspend or terminate access to Bernar if you violate these Terms, misuse the Service, create legal risk, or if continued operation becomes impractical due to third-party platform requirements. You may stop using Bernar at any time and may request account deletion by contacting us.
10. Governing Law
These Terms are governed by the laws of Finland and applicable European Union law, without regard to conflict of law principles. Courts located in Finland will have jurisdiction where permitted by applicable law.
